Access Rights To Neighbor's Septic, He Doesn't Want To Share.

I'm in the feasability period for a piece of land.

The lot has access rights and a maintenance agreement for a neighbor's drainfield. The neighbor has made it clear that he does not want to share the drainfield. Checked with the county/health dept, the septic can support another house and the access right to it is valid. I would have to dig accross his paved driveway to get to my drainfield hook up(on his property). Any thoughts?

    Is this your only option?

    I would pay a little extra to keep peace with my nieghbor. But if this is the only way or the other alternatives are too expensive I would enforce my rights to the drain field.

    I would have a real estate attorney look at the written agreement. This whole thing could get very sticky, particularly if you would have to dig up part of the neighbor's property. That may require you to have an easement and he doesn't sound as if he'd give it to you.
