Arkansas Land

I have been looking at buying land in Arkansas. However, what worries me is I will only be receiving a limited warranty deed. Can I do a title search myself or do I have to go through an abstract company? I have also heard that there is no longer a 2 year waiting period for aquiring "quiet title". Is there anyone that may have a little info? smile

    I'm sorry to sound like a broken record here, but I advise you to get the state of Arkansas statutes related to the collection of delinquent property taxes. Study them thoroughly. Only after that should you be actively investing, in my view.

    I have some lots in Arkansas. I have not heard about any change in the 2 year rule. They did recently change the redemption period from 30 days to 60 though.

    The big thing to worry about in arkansas is sometimes the land commissioner will invalidate your sale a month or 6 after you bought the lot. This can sometimes be very aggrivating if you already have it resold, as I usually do. The reason this happens is if the state put the wrong legal description on the parcel.

    Hey thanks for the advice Ron, but as you can see with just 3 posts I have only been on here for just a few days so your post is new information to me. I have checked out the State of Arkansas statues and do understand them somewhat, however as with some things someone usually can explain something in such a way that it "clicks" and you understand. I just didn't want to get into something and regret it later.

    Title company people in Arkansas must age very quickly over both incorrect or mismatched legal descriptions and the state's invalidating conveyances.

    you must be very careful about buying tax deeds from long distances unless you have a way to do a title search on the property. most of the properties on the negoiated tax sale list in Arkansas have mechanic's liens or city clean up fees. I'm saying all, but in my experience most do! also, you should view the property before buying it.

    remember, you are really only buying the State's interest in the property. They are indeed deeding you over every lien that is attached to the property. Sometimes the property does not exist at all. In most cases, not everyone is notified about the sale and thus their interest will not go away. You need to check with their offices.
