Eviction Lawyer/Attorney

Hi All,

I am an out of state Landlord and I have two co-tenants in a property in Kansas. I just received their July rent after posting the “Notice to pay or quit”. However, they have not paid the late fee as outlined in the lease agreement. I want to start the eviction process and need to get a Real Estate Attorney to work on this. Does anyone have any ideas on the best way to find an eviction attorney? I tried some of the online services but they ask for so much personal information that I decided to pass. Hey, Maybe this is a service TCI would like to look into.

As an aside, there was some damage to the downstairs wall due to the Tenant’s letting a toilet clog up and overflow. Is this damage the responsibility of the Tenants or the responsibility of the Landlord?

    First a question about out of state tenants. How many do you have? In general has it been a good experience?

    I'm looking at getting some out of state properties to rent. Do you use a management company? If not, how do you show the property to potential renters?


    In Utah, you can't start the eviction process until they are past due. If the landlord accepts any consideration they have to start the eviction process over.

    I would send them a notice saying that their late fees are due with their August rent. If they don't pay their late fees again. Begin to add interest to the late fees according to your rental agreement and reinvoice.

    As the for damage, you may have to prove that they were negilgent tenants. Did they try to clean up the mess as quickly as possible or just leave the mess there to cause damage.

    I would give them a call and calmly ask them about their situation and why they were late with their payment. Have they been late before? How long have they rented from you? If you don't like the answers I would consider asking them to leave by July 31 if you are on a month to month. If your in a lease you might use the water damage to break the lease depending on how it is written.

    I wouldn't fix the water damage until they move out. Unless it was really significant. I would then use their deposit to fix it after their gone. How much will it cost to fix?
