First Eviction ! I'm In Florida - How Do I Do This Fast And With Little Problem?

My tenant has been late for three months. I have been very accomodating until this evening. I went to the property after hours to collect rent and he wasn't home. I went to leave a note in the mailbox and saw a forwarding address for the wife, step daughter and step son. If she left him that explains how he can't pay rent. They are both on the lease. The lease runs thru August 2004. Help!! The husband has been intoxicated 98% of the time I've seen him so I need to be diplomatic here. Thanks! surprised

    Are you saying he keeps paying his rent that he is late?

    If so how many days?

    October - rent paid by the 14th - with payments arranged by the 3rd.

    November - rent paid by the 15th - "forgot" to mail it and he was "out of town"

    December - some furniture in house - wife gone - "Elvis" collection packed! - ready to make a quick getaway - 9th and no phone calls and no rent!

    Ok so if I am reading correctly he is 9 days late and you suspect he is moving out.

    Well I would give the written notice and then hope he really is moving out and you will have his deposit and all will be good. Right or am I missing something?

    Yes he is 9 days late...maybe he is moving OR his place looks like crap because his wife left. I don't want him to stay on and think he gets free rent. I have only dealt with her until 3 months ago...I haven't looked to see if there is any freshly dug dirt ing the yard (yikes)!

    I just looked at the site you provided. I will post the three day notice in the am. Do I need an atty to file the eviction in court?

    I am NOT an atty although I DO play one on TV

    So just telling you my experience. I did not use an atty to file eviction in court. It was a while ago and I belive it was approx $127 BUT I could be way off. If it is that much you are probably better off trying to sit down and talk to the guy between now and when you can first file in court, and find out what is going on.
