Hey guys just droppin in anyway i acquired a rental property last year (sec cool smile whom the tenants had 2 dogs well as a dog owner myself i told them according to the lease they are to have no pets but since i am a dog owner myself as longs the dogs are no problems they can keep them well 3 or 4 mos later i got a fine from balt city saying the feces in the back yard were not allowed so i contact the tenant told them hey pay it and please dont let this happen again well all was good until last wk i dropped in on the property unexpectedly and open the door to the basement a smell hit me like no other when i got down there it was dog feces and dog urine all over the basement floor (not carpeted) so that was the last draw for me i told them thats it get the dogs out in 30 days oh i forgot to mention they also have a cat but it kinds of gives me a strange sense becasue a few days later i read an article about tenants with pets and how much income they can give u because people usually dont rent to them. any suggestions?

    Wow, peed RIGHT in front of you huh! Seems this tenant WILL be paying to replace the carpet.

    I also prefer no pets, but have had to bend that when market conditions dictate.

    Strictly no pets at all period. I have found there is no such thing as a "safe" pet. Small dogs and cats can tear the place up and pee all over just as much as big ones.

    Birds can be noisy and can also make a mess.

    A friend let his tenants have fish in a 20 gallon aquarium. Guess what... The aquarium had a slow leak that no one noticed till move out time. Destroyed the wall behind the aquarium and completely warped the floor under it.

    No pets period, ever.

    I will also lease to pet owners with dogs and cats, max of two, under 25lbs. I do require a non-refundable pet deposit, along with a signed PET ADDENDUM.

    Which states the local laws and our community laws!
    I make sure that the resident(s) understands, that us allowing them to live at our community with pets, is a PRIVILEGE! Sometimes, they seem to get confused because of the non-fundable deposit.

    And at any time that they violate the rules, they will be given a option to cure, and after that, if not cured a 7 day to cure resulting in losing their pet privileges.

    I have found that not only the residents that are responsible in keeping their pets on leases and picking up after there pets. That the residents that are not pet owners appreciate our efforts in enforcing the rules.

    I also require that pet owners that live on the 2nd floor, in a four unit that has a foyer maintain that area. vacuum,sweep,air freshener,etc.

    TMKern,
    FYI, all security deposits (including pet desposits) MUST be refundable. You cannot state they are "non-refundable".

    Now, if you find damage that warrants you keeping all or a portion of the deposit you have to notify the tenant of that and that is obviously allowed and what they are intended for.

    Lavonc - I believe non refundable deposits are ok in AZ and also in NC.


    Arizona:

    § 33-1321. Security deposits

    B. The purpose of all nonrefundable fees or deposits shall be stated in writing by the landlord. Any fee or deposit not designated as nonrefundable shall be refundable

    North Carolina:

    ¤ 42-53. Pet deposits.
    Notwithstanding the provisions of this section, the
    landlord may charge a reasonable, nonrefundable fee for pets
    kept by the tenant on the premises. (1977, c. 914, s. 1.)

    You can specify how many people in the house. The general rule that should not land you in any hot water is 2 adults per house and 2 kids per room so in a 3 bedroom you would have 2 adults and 4 kids.
    If you talk rental with folks even if you do not advertise you are answerable to Fair Housing.[ Edited by linlin on Date 06/12/2007 ]

    55+ is a special thing, and a legal loop-hole

    I was told that adult communty, adults only, no minors is the same as no children which is discriminatory.
