Joint Driveway Agreement?

I have SFR rental property where their was / is recorded a "joint drive way agreement" between two specific parties (original owner and next door neighbor).

Since then, both properties have changed hands (sold) and neither of the original owners can be located to void the agreement......any suggestion.

I did speak with my lawyer about this,
who stated that it is customary that such agreements are attached to the land....but he could not site anything other than customary procedures.

I find this ridiculous........for no other reason that the agreement states that all maintenance will be jointly shared....if that is the case then the new next door owner is responsible for something he new nothing of.........

I approached him about signing off on the joint driveway agreement as suggest my my lawyer but he feels he should not have to sign off on anything since he was not the original owner (which I understand)........not exactly Mr. Friendly either.

    Possibly you can look at having a surveyor come out. This would allow you to know the boundaries of proeprty line for each party.

    In addition it will pull up your responsibilities per each party for maintenance if attached to the deed. Hope that helps
