Charged off debt and collection actions...?

Can a creditor who charged off debt sue you for collection post charge off? It appears from correspondence received that the debt has not been sold to another credit/collection agency. Original debt was in California in 1992. No payments have been made on balance and credit report is actually reflecting the charge off... help!? confused

    If this was technically a chargeoff in 1992, it should no longer be on your credit report. The easiest way to take care of this is to deal directly with the agency and negotiate payment -- that is you will promise to pay this and they promise to remove the chargeoff from your credit file. I would get this in writing so that you have a letter to submit to the credit bureaus in the event that they fail to do this as promised. You should also get a letter from the agency indicating that you have paid this off as well. Good luck and hope this helps.[ Edited by mgvalerio on Date 06/25/2003 ]

    The debt is long past the statute of limitations under California law. Do not pay them anything. Learn your California debt collections code. California gives you many protections not available in most other states.
