Mental Block - Letter To Tenants

Lease ends on April 30. Gave them new MTM agreement in late March to start from May 1. Yesterday one of the tenants says, "Maybe we'll move." What does maybe mean? Will you or won't you? "Yeah, consider as saying that we'll move out." Fine.

Now I want to send them a letter reaffirming what we discussed on the phone and putting in writing their final rental date.

Only I've got a mental block and can't think of how this letter should be worded. Any advice or examples would be really helpful. Thanks.

    Does the current lease not have a 30 day notice if they plan to move out. Send them a letter with a sase that simply states Do you plan to move before May1( ) or continue renting month-to-month ( ).Please check the box with your intention and return asap.

    Most leases state that tenants must give 30 day written notice to move. This is true even if the lease is set to end. Most leases convert to month to month once the lease ends, provided a new lease is not signed.

    Read your lease. Send them a letter saying that their lease will end on date _____. They must give you 30 days written notice prior to moving. If they plan on moving they should state so on this letter, sign and mail back to you. Once you receive the letter you wil begin marketing the property immediately and that you plan on having another tenant move in on the date after they move out, which must be by midnight on _______. Otherwise they might get lax about moving and they stay over and you have a new tenant wanting to move in. Read your lease about hold over tenants.

    In this case, all notices have to be done in 30+ days intervals. You sent out a MTM agreement in late March which becomes effective the 1st of May. That notice prevails. The tenants are now obligated for at least the May rent. Send them a letter reminding them of the inception of the new MTM lease and any change in the lease terms which begins in May.
