Depends on your area, real easy way to get your answer would be to call an attorney. You need one anyway, so why not get your answers from them. Find a good one and you'll have a lot of answers to your questions.
I know how it is at first, it seems easier to just post a question and hope someone will come along and help. You want to brush up on your knowledge before dealing with some professionals in the industry. But seriously, the best thing to do is find out answers from the source.
