Federal Tax Lien

Anyone have any experience dealing with Federal Tax liens on a property you are trying to short sell? I am trying to short sell a property w/ a federal tax lien. The person the lien is on, is the ex of the person I am trying to do a short sale with and is no where to be found. Any comments on this would be helpful.     The lien goes with the property and as long as it is certified and rerecorded as needed will continue to haunt the property for many years. A quiet title suit may be able to clear this, but not much else can.

    How old is the Lien?

    Federal Tax Liens go away after 10 years.

    You may want to go to your local Federal Tax Lien office and ask for a form to "release the lien." (I forget the exact name of the form) Maybe they'll negotiate?

    Can You file a quite title in your state.
    This would clear their interest in the
    property.

    YES!

    A quick internet search reveals that Quiet Titles are done in Tennessee.

    if you search

    "Quiet Title" +Tennessee

    It will give you all the information and even name of law firms that do Quiet Titles.
