Short Sale Without Foreclosure

Can you do a short sale without the seller being in foreclosure? I had a guy contact me yesterday, major health issues, just wants to break even. Has stopped paying his taxes.

    I have never seen it other then in a bk or foreclosure.

    50% of my short sales are not delinquent at all, or are minor delinquency with no foreclosure filed.

    We have gotted them done without them being behind, but they seem slower to get a response.

    I frequently renegotiate lower offers after I have received an approval. You never know until you ask...
