  All the disclosures in the world will not keep you from being sued.
  
  That said they can go a long way towards avoiding a lawsuit.
  
  I would just be up front about what is involved and the possibility of a 1099 or deficiency judgement.
  
  Generally there is no deficiency judgement if a successful SS is obtained but there will be a 1099.

  I get it signed every time I do a deal, it is there with the purchase and sale agreement unless it is a straightforward purchase.
