"Legal Squatters" & "Illegal Evictions"

Bearo profile photo

I bought a Rehab Property in Durban, South Africa.

I bought the prop outside the Sheriff's Auction from the Bank as a Repo.

The bank had to transfer the prop back, from previous owner, to them and then to me.

Unfortunately - there are now 3 "legal squatters" in the prop (from previous owners' friends).

The bank is now busy with legal evictions (8 months already). My transfers docs have been signed. If my attorney launches the prop will be mine in 7 days.

My question is:

Should I wait for the Bank to complete legal eviction (they pay)? OR

Should I launch - register prop in my name - AND MOVE INTO MY PROPERTY - in others word - get them out the hard way?

I need your urgent response! >smile

Laws can vary from state to state, and I'm not sure how AL(?) compares to IL, but,
I have done my evictions all on my own, and though most are extremely aggrevating, can be efficiently done.
File the papers with the county sheriff, in IL they do the physical eviction, and go from there, it could take 1-2 months depending on the schedule, but if the property has been transferred into your name, I don't see a problem.

Also, there are no legal squatters.
If they are not the old owners, kick them out.
The only problem could be with tenants, but then they should be paying you money.

Contact a good real estate attorney and ask some questions

    Good Luck
