Ruling By The Judge In Eviction Cases

I just got back from eviction court. I tell you the judge hearing the cases was all for the tenants. This judge ruled for the tenant even when the property manager at legal representation present. She (the judge) rule for the tenant because the property manger did not answer one of her questions correctly. This judge was pro tenant all the way.

I recommend everyone that is renting property out to tenant and managing the rental themselves to go down and sit in on at least one days session before filing to evict a tenant. I repeat, I recommend all landlords that have never evicted a tenant to go down and sit in on a few cases.

I arrived late, I missed my name being called. The case was dismissed. I have to re-file and come back in seven days. From what I saw of this judge I am not sure if I could have got her to rule on my behalf anyway. This was in Lexington, Ky. The eviction process in nothing like this in Georgetown, Ky where I have evicted with ease.

    Well, you are kicking someone out of their house, so it's taken very seriously. Besides, you're viewed as the "rich landlord" so you will not get as much leniency as the "poor tenet".

    Generally, you want to have all your documentation in order and be as professional as possible. Being late isn't going to endear you to the judge, but if you dot your i's and cross your t's, things will go your way.

    When presenting your case, stick to the facts and reference how your lease agreement was broken. You want to be viewed as the "good guy" and hopefully you didn't do something dumb like sabotage the A/C to get them out faster.

    F/U, I showed on time today. The judge was 20 min. late however. The tenant did not show this time. So the judge ruled on my behalf. This was a different judge than last week.

    Lesson learned: Show on time, have all your ducks in a row. The cost of eviction goes up, by having to re-file and the tenant gets another free weeks rent. <IMG SRC="images/forum/smilies/icon_biggrin.gif"> [ Edited by Vern on Date 08/29/2003 ]
