Landlording And Bankruptcey

here is the problem my partner tried to evict a tenant who was renting. the tenant filed bankruptcy and included her behind payments in the deal. she is not on a land contract so my friend took her to court to get her evicted the judge said she could not be evicted because she included the landlord in the bankruptcy filing. is this legal or do the judge know anything about real estate? need some feedback from long time landlords?

shadow, i'm not a lawyer or long-time landlord but i happened to read an article on it today in the Legal Intelligencer here in philly. they have an article which deals specifically with that. i can't type in the whole article and can't really remember the gist of it, but maybe you can find it on the site - http://www.palegalpubs.com/

i hope there's some answers there for you!
