Assignment Of Contract

I am going to put a deposit on a house today. It is an assignment of contract, in Miami, FL. It is renter occupied, month to month. I dont know if I should wait on closing until they are out, or if I should have the current owner give them notice, to the end of Feb.



Please give any advise. I do not want to have to evict them if they do not leave when I take ownership. I want to get in, do minor updates, and sell for profit.

    FYI - If I have the owner giver them notice, then I would close asap and work on the exterior during the day.

    I AGREE, SOME PEOPLE SAY "KEEP THEM, THEN YOU WILL HAVE THE INCOME"

    BUT - IF I UPDATE THE INSIDE, YOU ALL KNOW THE RISK OF DAMAGING ALL THE NEW APPLIANCES, ETC, IS NOT WORTH THE INCOME... IF YOU FEEL DIFFERENTLY, ENLIGHTEN ME, I WOULD LOVE TO CONSIDER IT.

    I JUST WANT TO CLOSE FAST IS ALL, BUT I DO NOT WANT TO TAKE THE RISK.

    Keep the deposit! If there sincerely is NO mold, I would take them to small claims court. They have good information and credit to go after. It really irks me when deadbeats portray themselfs as legitimate renters.

    I had one renter about 10 years ago, give me deposit and had me cancel remaining callers...2 wks later, out of the blue, she says the carpet smells...etc..etc. I kept the deposit and went after her for 1months rent, after i released the place. I actually got the judgement and collected from her bank account, all she got was a statement from the bank. The bank told me they had to give me all the money she had in the account, since

    I would first try to use up the deposit on "cleaning and repairing" the unit, I would think that you are more likely to be able to keep it for those reasons than compensation for lost rent.[ Edited by rehab2day on Date 02/05/2007 ]

    Keep all of the security deposit and respond to the tenant with a certified letter, that since the lease was terminated prior to the end of the lease term, the security deposit has been retained. Clean the unit up, and re-rent it.
