House With A+ Potential Listed With Agent

I have very good l/o potential but the house is currently listed with an agent. The owner did the listing but has received 0 interest in her property. Her husband has already relocated and she is ready to move. Would her doing a lease option deal with me violate her agreement with her agent? Any suggestions would be appreciated! I loved these motivated ones!

    hey a fellow south carolinian!!!

    actually i believe that if you were to try to pursue the L/O, i believe that it would in fact violate the contract she signed with the realtor. you can always have her call up the realtor to tell them that she no longer wants to list it and/or pay the realtor off for the listing expenses (no more than about $500, if even)

    but the contract she signed with the realtor protects the realtor from her selling the house behind her back unless the realtor gets a verbal and written notice of the cancellation of listing.

    of course thats my understanding and i'm not completely sure, more expert advice from more qualified individuals are needed.

    Its a game you play, sorry but every now and then the grownups have to get down on their knees and go at it.

    The Owner of the Property sends a letter to the Real Estate Broker. Quotes the Listing Agreement. Then makes a statement informing the Broker that the Contract of Listing is hereby Terminated for Cause and the property is withdrawn from the market. Signed dated, and return receipt requested. You let the tock tic and wait for some form of communication from the Broker. If none your listing is cancelled. If a response you answer that depending on what is written. Most of my clients at that time state that they have been damaged by the negligence of the broker by not selling the property in an up market. The market has now turned and the Owner has put the property into the hands of her or his or its attorney. The End.
