Seller Wants To Back Out In Florida--can He?

paulmcconnon profile photo

I have a house under contract for 235k that's worth 350k . Seller had his attourney send me a letter saying he does not want to go through with the deal. I want to buy the house to live in. I do not want to be paid to forget the whole thing. This house is in Florida. My attourney sent a letter saying thanks for wanting to back out but no thanks. Does anyone have any experience in Florida on this matter? Armchair investors that do not have specific experience on this topic please do not reply.
Thanks.
Paul

    paulmcconnon,

If you were after the "right to refusal" stage of the contract than, no the seller cannot just back out of the deal. Your probably going to court if you want this property bad enough.

    Paul,

It depends on how the contract is written. What does the contract say if the seller defaults?
