Power Of Attorney

Hey gang, if I have a notorized full power of attorney for my partner, can I sign everything for him? He cannot attend the closing so I was planning on attending and signing for him. The loan is in his name alone and the seller's agent is giving us grief. I thought the POA gave me authority to sign anything......contract, closing docs, etc....yes?

    I'd back off and have my lawyer write strong letter to seller's agent notifying him/her that you do have the GPOA and it's all you need...and that agent better not stand in your way.

    As for that obstructing the "closing", if it's an escrow co., then they're the ones to deal with your GPOA...but again your lawyer may need to help them with their thinking to make sure they know their duties.

    As the buyer you have more clout than the seller would in forcing things to happen...as your deal, if obstructed by the other side's agent, could very well be converted into a sizable lien and cloud on the seller's title until S closes as per your agreement.
