Land Trust - Contract merger
Is it likely in a land trust deal that the courts would look at the benificiary agreement and lease agreement and consider the contracts the same and merge the contracts?
The concern is that language that seperates the two contracts could be stricken.
The basis for this would be something like same parties and same subject therefore same contract.
