pljv profile photo

Okay this is my problem. can someone help me with this/?
I have a least that have 2 years left, but I want out. I can't afford to pay the rent anymore. The bussiness is not pulling in enought profit to even cover the rent of the unit, let alone my house payments and many other expenses.I would like to break the lease; I have talk to an attorney about this and look over my lease he said it can't be break.
So... I'm thinking of just quit and move out.
My question is If I have my house on sale
Can my landlord go after my house or my account to get the remainig lease.I have 50k invested in the house. Can they take that equity away from me . that is all I have.
please give me some advice.

If I do a Lease to purchase.
The property is still under my name for a period of time. Can the landlord still go after my property eventhough I have someone else lease the property.

    pljv,

    Glad to meet you.

Does your state have homestead laws, this is where your house is protected up to a certain amount of money from creditors. If you give us where you are from we can look it up.

As far as I know about leases if you break one most states 'not all' the Judge says you only have to pay about 2 months payments as a settlement because the Landlord can re lease the property. This is if the Landlord takes you to court. So the Landlord is really not out the full dollar amount of the lease period.

Welcome on board this board, let us know about what State you are from.

    Hi pljw,

John Locke ask me to look in on this for you.

I checked out Chapter 6.13 RCW and yes there is a lot of info on homesteading.

What you might do is visit your county recorder's office and ask for a Homestead form. Our recorder's office in Las Vegas has them on hand, at the front counter, for people that hadn't stopped and filled one out at a legal forms store.

Should be a pretty simple task once you get the WA form.

Let us know how you make out.

    Best of luck

    Hi pljv

Chapt 6.13 of the Revised Code of Washington (statutes/laws) is where I found the regulations for homesteading.

A homestead form is how you delare your homestead (at least here in Nevada). The procedures may differ slightly where you live which is why I recommended you seeing your county recorder.

    Best of luck

    John (LV)
