Title Search Information Queston.

The title search I just got done does not list the bank that is foreclosing on the property. I am asuming that the the loan was transferred to the bank through one of the many bank mergers over the past years. Can anyone offer suggestions on how I can find out who the current lien holders are? Any and all help would be appreciated.

    The easiet way would be looking at the County Recorder records and view the complete history. Not all states require the recording but this is where I would start. If you have a friend at a title company ask them - they can pull up the history as well. The final straw would be the trustee announcing the trustee sale will tell you who the beneficiary is in his/her newspaper ad. Hope that helps.

    The court house gives me the run around.

    I called the title search company and they claim there is no other information available on the title. They have sent me everything.

    The lended claims that they cannot tell me if they are the first, second, or third lender.

    The paper listing the foreclosure for the county does not record the lender who is foreclosing.

    The bottom line is that I think the primary is the one forclosing on the property. It is just that the bank has merged with the one listed on the title and it doesn't say who the now merged bank is.

    I understand your frustration but by law the party foreclosing must be listed in a public place - i.e. courthouse, local newspaper. At such time the foreclosing parties name is disclosed to the public - this is so that the claim that the person being defaulted upon can not say they too didn't have a means to contact the bank foreclosing on them. Hope that makes sense
