What you and your husband want to do is common. He can do that if he wants. It is not illegal. The mortgage company could call the loan due if your ex-husband is violating the contract, that's if they find out.
I am not a lawyer or giving financial advice only what I have seen on my own contract with my lender. There is a clause that states they can call the full amount due if a change is made with the title.
