How Do I Obtain Excess Proceeds Ofter Forcl. Auction

dakirkley profile photo

Can anybody tell me the process to redeem the proceeds over the balance due to the foreclosing lender once the property is sold at auction? I understand that any amount that the property sells for at foreclosure auction over the balance due + legal fees etc. is due to the homeowner. Help

Thanks,
Dave

If you are the homeowner, you should already have the answer to that question. You were served with a notice of the amount of the final judgment. In that notice it will tell you where the "over-bid" money will be deposited (with which court." You will need to petition the court for your money or it will be escheated to the state after about 90 days.

Dave why would you think this!

Secured creditors get paid first and the amount left will go to the homeowner.

What are the details of this case so that you can get a better answer?

You will find that many states will require one to be licensed and bonded to provide such a service.

By researching the sale, documents at the courthouse may provide the leads you are looking for.

I believe to assist someone in accessing that type of info no bond or license would be needed. Why?? makes no sense sounds like a good nitch!
