Garnishing Wages

SolutionsKid profile photo

Trying to help a lady with a short sale. She has a first with homecomings and a 2nd with citifinancial.

She just found out that someone (either Citi or the court system) is garnishing her and her husbands wages. She called me crying because she doesn't know what to do and if they garnish her wages she will literally have nothing to live on.

What can be done? So far on my end I know the 2nd will take much less but the first is being stubborn as hell. Even when I broke the realistic numbers they still didn't move and kept believing the property is worth way too much.

I at least want to give this lady some direction to turn to or know for myself what can be done in situations like this.

Thanks,

Have her go to the court house where they do the small claims and ask the clerk about a hardship, If she can prove to the judge that she wont' have no money to live on then he/she will grant her a hardship this means that she won't have to pay.
One more thing is she should have went to court for them to get a judgement on her, inless she couln't be served the papers{wrong addr, moved, ect}then they will ask the judge for aliase judgement but for them to garnish her they have to know where she works, so that means that they should of been able to have here served.
Court House find out who, what where and why.
I hope this will help you.

Most big cities and most law schools have legal clinics for needy people (the former is typically a function of the local bar association, i.e. the Denver Bar Association rather than the Colorado Bar Association or the ABA). Try to hook your folks up with one of those. They need help as quickly as possible to get the garnishing down to a minimum.
