confused The discussion boards of the local RE Investors organizations have been having some serious discussions about the legality of bird-dogging in Texas.

It seems to be that only those who have a RE license can legally locate properties.

I was approached by a RE agent about finding properties for her and I would be given a $50.00 gift..she could not pay a referral fee.

Does anyone know if it is legal or illegal to be a bird-dog in Texas?

    Hi Maude,

    I know that a Texas licensed broker or agent cannot pay an un-licensed person a commission or referal. They can give a 'gift' not exceeding $50 in value though.

    If the person you are bird-dogging for is not a broker or agent, but simply an individual or investor, I don't think the above stipulations would apply. But, that's just my opinion.

    ok i'm no expert on this, but how can it be ILLEGAL for ANYONE to go out looking at/for properties and then passing that information along to someone who might buy it?.....that's simply ludicrous!!!.......and this is not targeted at you guys here who have posted the question and the response, but the nerve of the agents to say that........your family member could be an investor and you were driving by, saw a fsbo sign or a vacant property and picked up your cell phone to pass along the information, so what if they pay you for that information? I hope it's not illegal, because if it is, i'll be in jail very soon!!!!

    The way the discussion boards go, there are lots of quotes from the 'law' and why it is illegal..it really becomes nitpicking talk wiith the final word being 'it is illegal'.

    It is really scary for newbies..
