I was told by an attorney that "birddogging" is illegal without having a RE license.

No It is not illegal in NY. The attorney probably did not get quite what you are doing. You see when you find a house and tell some one else about it(and get paid for it) you are not getting paid in any way for the parcel of real estate you are getting paid for info, which last time I checked their was no law against it. Wholesaling you just become a principle in the deal and then that makes it not illegal.
