Can Tax Lien Affect Sale Of Property

spikerz3 profile photo

I want to buy a personal property (mobile home) from someone who has a two recorded state personal income tax lien. The property itself does not have a lien recorded as far as I can tell. How will the tax lien on this individual affect me if I buy his property?

In Florida, in a straight sale (you and owner) the title company will not deal with it until it is settled (the backtaxes). Income tax lien attaches to all property according to the irs so if they filed a lien it liens all properties.

I say talk to a title company and have them do a search (about $50 to do it) and make sure it is lien free and can be insured

If the personal tax lien has not been placed upon the subject property than it should not affect the property it self.

You may be dealing with two issues and you should run a title search on the real property (land) and a title search on the mobile home it self.
