How do I go about persuing a qick claim deed? A friend of mine is going to be filing for a divorce and I was just wondering how long it takes to do a quick claim deed. She would like to sign over a cabin that has been in her family for years without loosing it through the divorce. Please reply ASAP, if you have any input.

    I am not sure of the context of your question. A quit claim deed basically relinquishes interest in a property. They are often used in divorce settlements where a couple own a property together and one of them is to get the property in the settlement.

    I don't know what you mean by "sign over a cabin". To whom? If the state where your friend lives is a community property state then the cabin is likely separate property if it has been in her family for years and it was willed or given to her as separate property, it should remain that way and not be subject to division as community property unless community assets or her husband's assets were used to make payments on the cabin.

    The first issue at hand would be the research issue on what her spouse is entitled for through the divorce.

    It sounds like she is attempting to hide an asset, is her future ex aware of the subject property?

    Has the divorce been started/filed?
