Title Issues (Problems)

I am in the final approach in selling my personel residence. was suppose to close yesterday. at the last minute I find out that there is a lien against the title since 1971 ( I was in grade school) I bought the house in 1994 HOW in the world did the settlement company not find out about this before I bought the property and now that I am selling the current settlement company found it??
there should be a law or a recouse that I can take against the first company that did not find it?? if so HELP and btw I am suppose to close in a couple of days I did buy title insurance at the original closing confused

    Call your title insurance company, that is why you buy title insurance!!!

    It is in your docs somewhere, call your lawyer who closed your property too

    I spoke with the people that closed and they said they could not get the file from storage until tommarow I asked them to submit a leagle document stating that they will be submitting Certificate of insurance to the current settlement company when they did, the current company stated that they will not accept it that they wanted me to pay 2300 dollars in escrow until the matter is settled. I did not appreciate that because it is penalizing me for something I had no controll over.

    Stick to your guns, don't get pushed around. People want to profit off the extra work but it isn't your problem! Just keep things moving. Sounds like you are doing just fine. Good luck
