I am currently working with the owner of a rental property that is occupied by a Section 8 tenant. Before I go forward with trying to take ownership of the property, I would like to know exactly what I might be faced with regarding this tenant. I would like to terminate the lease (with adequate notice of course) and pursue getting a tenant/buyer for the property. If anyone can provide me with some insight as to regs regarding section 8 tenants, it would be much appreciated.

    Honestly, you probably are facing a lot of rehab work on the property. My advice is to keep the tenet until the Year lease is up. Since the damage is done to the house, you might as well get as much money out of it as possible.

    Outside of that, all you need to do is contact the tenet and the Section 8 office and they can relocate the tenet at the drop of a hat. They always have apartment complexes and public housing available for their section 8 people.

    Generally you will have a lease with the Section 8 tenant and a section 8 addendum that modifies this lease in certain respects. If the tenant is in breach of the lease you are free to evict her. Otherwise, you are stuck with him/her until the lease expires (unless you can entice them to leave).
