Notarizing Trust

When I purchased my first property (2yrs ago) I recorded the deed in the name of a trust (property address trust, trustee). I completed the trust and signed it at that time with my trustee, but never notarized the trust.



Since I never notarized the trust I am wondering if the warrant deed is still valid. I can get the trust notarized now but it will be two years since the deed was recorded. Any help would be appreciated. I live in Texas.

    Gary,

    Not to be argumentive, but how will a land trust protect anything from current litigation?

    I would think that any anything you do with an asset, may be overturned by the court.

    Just curious.

    In rereading your post, I noticed you mentioned that the lender reimbursed your Contractor as the work was completed and inspected.

    Normally a lender requires an affidavit signed as to the fact that materials and subcontractors have been paid before they pay the Contractor. If your Contractor signed these papers, and actually did not pay for the materials, you have your evidence of fraud, which is a criminal matter. Talk to your lender!
