Nevada Legal Question Please!

introuble profile photo

Our house was foreclosed on. We were evicted, my question is on property recovery. We had to make an appointment with the real estate agent that represents the bank to schedule a time to get our personal property out of the house- they said they had to be there when we moved our things so we didnt take fixtures etc. The first 2 appointments- the agent did not show. The 3rd one we started moving at 8AM they had other things to do and told us we had to reschedule to get the rest of the stuff- this was at noon. They missed the next appointment and now we have one set for friday. Getting to the point.... lol the last time we were there my husband questioned why the agent was in the house the previous week and going through our belongings. He told them about the Nanny cam we had running that caught the whole thing. The agent got irate that he asked the question thats why we had to stop moving at noon. On the next appointment we have the agent said I was the only one who was allowed on the property to recover my things. If my husband showed up he would "shut the whole thing down" and I wouldnt be able to get our property. I am 7 months pregnant- it was a 5 bedroom 2500 sq ft house that we lived in for 25 years- there is no way I can do it without him. Ah- the point is finally here....Question is- can the agent or his reps legally keep my hubby from helping to finish packing our property? If I cant do it myself can he just keep whats left? Please help- sorry for the long post. thanks

    introuble,

    Glad to meet you.

I was sitting in court waiting my turn to evict someone, when a landlord who was gettng his turn before my turn. He admitted to not letting the people who were just evicted return for their personal property. He even admitted he sold some of the property to recover his back payments owed.

As this Landlord was removed from the court in handcuffs for not abiding by the law I wonder how this real estate agent would feel about talking to this same Judge.

I know times are tough for you but you do need the help of an attorney, if you private message me I will set you up with one who can help you, of course my treat.

You cannot be denied your property. John's offer is very kind. I don't think you need an attorney.

I would contact the bank and talk to the head of their REO (real estate owned) department. Explain the situation. I'm sure that the agent will have an "attitude" adjustment. There's big liabilities there for the bank and the real estate company

I have a friend back east who spent close to $60,000 in fines and attorney fees because he didn't property release an evicted tenants personal property.

You've already got some great advice, but I just wanted to add that you might want to tell that agent's RE Broker about the agent's poor, possibly illegal behaviour...the broker isn't going to be too pleased about his agent's shenanigans.

Also I'd report the agent to the NV RE Commission in a full, formal complaint...that will get the agent's and broker's full attention so richly deserved.
