Hello, Not Sure If This Is Where I Ask A Question?

found this site while looking for forclousure information, and saw you were helping answer questions,, if possible i will ask, and if not able to respond, then ok,, so anyway,, have home, we had sold it on land contract 4 years ago, home was torn up by buyer, we owe too much to have made payment, person moved out, no notice, we are 4 months behind on payment, had been talking to morgage company on reg basis, and had asked them for a short sale, or deid in lue ,,, we do not have income for all of our bills, had the home appraised a year ago, after damages,, it appraised at 60.000 , and we owe 95.000. just recieved letter from attorney, that was representing mortgage com, and said it was turned over to them for initiation of forclousure proceedings against us and our property,, nothing else said except to write them within 30 days, if we disagree with amount of debt owed??? i had discussed with mortg. company several times over this last 4 months, that we would just give home back, hand them keys, or try to sell, if they would settle with us somehow?? they kept saying just wait while it was being looked at by a medieater of bank?? and now we recieve this letter from attorney?? we will have to file bankrupcy if they sue us for this debt ??? should we get a lawyer before this goes any farther to protect us?? should we file bankrupcty?? if you have any input please answer,,, if not what you want to discuss on this site, i understand and apolozie for wasting your time. thank you. rolleyes

    Yes you want to hire an attny.

    You are a prime canidate for a short sale but you are going to need help to do it. Be careful in selecting the attny to get somebody who has done other short sales. He may also know some investors.

    I hope you have supportive documentation of your communication with the lender.

    You have many methods such as:

    Special Forbearance
    Loan Modification
    Partial Claim
    Pre-Foreclosure Sale (Short Sale)
    Deed in Lieu of Foreclosure

    Bankruptcy is an option that can stop foreclosure, at least temporarily, and give you some leverage to resolve the foreclosure.

    Procedural errors in the lender's foreclosure or lender errors when you acquired the loan could permit you to file a lawsuit to enjoin or stop the procedure.
    An Alternative, HUD-Approved Counselors may be of some help although it is not a HUD backed property.
    HUD-approved counseling agency. A counselor can help you determine which options might be available and negotiate with the lender to work out a repayment program. Call 800-569-4287, weekdays between 9:00 am to 5:00 pm Eastern Standard Time.

    thank you for the help and comments, was served with a summons that we are being sued yesterday, called the lawyer who is working for the mortgage holder, and he said that it was up to washington mutual to work with us, if they will, i have tried to get them to call me back, the mediater from washington mutual., but she has not returned phone calls, to me. she has not called me since, she recieved all of our info she needed. he also said that we are in first stage of forclosure, and had plenty of time if bank works with us, for other options, like deid of lue, short sale ,, i suppose i will have to start contacting lawyers for us, since we are not sure what this is all leading too, thanks for help.
