Getting The Ex Off The Title

Hoping to buy a nice 5 acre property, but a little concerned about the title. County records show the ex is still on title, though the divorce doc--dated three weeks ago-- clearly states she got sole title to the property. Is that sufficient, or must she also get him to sign a Quit Claim Deed before I can buy it?

    Well you don't mention which state you live in so its a little tough to answer specifically. But I'd certainly ask for a warranty deed from the husband. Given the divorce decree he should have no problem doing that. In fact had her attny been on the ball he would have asked for it as part of the divorce settlement.

    If she doesn't want the ex to know she's selling it to you yet he could always deed his half interest to her.

    Only safe way to buy is for you to get title policy. That way, you know whose signatures are required...otherwise you're guessing, and that's a recipe for disaster.
