Chemical Contamination - Pesticides

hello1 profile photo

We purchased our dream home home on October 21, 2005. My entire family became ill. There was nothing disclosed about prior termite damage or pesticide contamination. Hazmat vacated us from the home on Jan 12, 2006, due to 8% LEL toxins. We have researched the home and found it had major termite damage and had been treated. We also found the previous owners were also ill. The home was vacated by the sellers 5 months prior to our purchase. Is there a legal recourse for this information not being disclosed? Please help!

If a licensed and bonded termite company improperly applied the chemicals they would be libel. Find them too.

This article pertains to sub2, but should help you with your DOS concerns:

Assuming your situation is simply an entity change and not a sub2 deal, you may consider adding your LLC as a loss payee AND an additional insured to your existing policy.

The correct way would be to technically name the LLC as the first-named insured. If you then add yourself (as the mortgage holder) as an additional insured, you should keep the lender happy...
