Advice On Dealing With Lender

1sttimebuyer profile photo

I have a mortgage through Ocwen Federal Bank that is now in foreclosure. I have been trying to speak with them for 34 days. Ive left phone messages, sent a fax and sent many emails trying to work out a payment plan but they will not call me back. There was a mortgage company willing to do the refinance but was unable to get a return call with a payoff amount and now the loan is 90 days late so the other mortgage backed out of the refinance. I recieved a notice saying there is a sale date scheduled for the property but cant get anyone to tell me when the sale date is. I just saw Ocwen on www.badbusinessbureau.com and they have 857 complaints and half as many lawsuits for unfair lending and many other charges- most of the complaints state that they do not provide you with information and they just proceed with the foreclosure as in my case. I am desperately looking for someone to refinance my mortgage with them. the balance of the loan with them is 227000 (do not know the payoff amount) and my home was appraised at 375000 last week. Credit scores are 600+. If anyone knows of a company or individual that will do this refinance -or give me information on how to get in contact with this bank PLEASE let me know. Thank you

As the lender has a bit of a reputation I would also suggest that you speak with the State's attorney general. See if they have any advice about how to force communication. Be prepared to supply some evidence that there is a clear pattern here and if you can show that it impacts other folks in NV that will help.

Sending a certified letter will only work if someone choose to receive it.

You could also speak with a lawyer but I would check with the state first as that should cost less.

The time has come, the Walrus said to cut to the chase. File an action. God knows you have the grounds. Sounds like either intense finger trouble among the employees in Loan Service or Loss Mitigation. Some organizations heavy into loan service just do not service and the harm they do. Oh my god. Stop it quick. If you do not know how to play the legal game get an attorney. Be sure he is wearing shoes and owns a form book or is on line with the friendly attorney service. But do not delay, you could get hurt.

    Go for it. cheers Lucius
