Asset protection?

 profile photo

I am 1 week out of a divorce and have lost nearly everything because my husband put everything in my or my parent's names and then when he recieved large judgement settlements against him that we were totally unaware of they came and repoosessed my car (yesterday) downer and my parents and I are in Chapter 7's and the bank is foreclosing on my home. I'm not looking for pity but struggling for hope. I like a previous post am concerned about any future assets I may acquire and how do I protect them? How do I begin to rebuild my credit? All help is deeply appreciated. Thanks.

Sorry about the tough time your are facing, but you can overcome this!!!!!!!!!!!!!!!!!!

Let me share a little info about my hero "Walt Disney" He faced many business failures, problems and BANKRUPTCY and then he created Disneyland.

Janis3 you are now at WAR with bad debt and you need to act and act fast, try to hold it together as this can be the most difficult time you will face.

There is great stuff to help you at TCI and great folks to help as well.

Let's get your POA together (Plan of action).

Get a copy of all three-credit reports, list all your known debts, and list all assets (those you can keep and those you can let go)

If you need more help email me, post at TCI and avoid adding extra expenses for now.

You need to attack this BEAST before you get into REI.

I know your pain. I have been through a similar situation 4 years ago and it is still a weight around my neck.

I feel for you. I am forcusing on REi so I can payoff my debts. But it makes me cautious for the future.

Please share with me any information you get. If you do not mind?

    I will pray for you.

    Janis3,

Very astute of you saying Asset Protection in your situation it is not about Land Trusts, etc. it is about personal asset protection so this type of situation does not present itself again.

A Land Trust, etc., would not have saved your vehicle from being taken.

Since you are starting over I would recommend a Family Limited Partnership, save up some money find an Attorney to help you with this, structured properly it will give the protection you need.

You will work out of this I am sure, just use your common sense, there are plenty of people here at TCI to help you.

Thank you so much for all the encouragement and the suggestions!!! I actually have a new well-spring of hope! I have begun the 14 Day Challenge ( the structure is just what I need). I definitely will look into th "Limited Family Partnership". It's funny, God works in strange ways ...if my AOL account hadn't been turned off by my ex I wouldn't have stumbled on this site by accident and thus never recieved the wealth of info and support! Thank you again -- I will keep you posted...my coffee is brewing and my business cards sre printing!!!! I am off to begin my REI career

Janis - I am sorry to hear about what you are going through. I wish I had some helpful advice but I am a serious newbie and all I can offer is encouragement. You will pull through this with no doubt because you are taking action. As a newbie, I must admit, that taking action isn't always easy. But, you are definately heading in the right direction and I wish you the best of luck.

In closing - I was hoping that you or DarrikAli could pass on that information about the 14 Day Challenge to me. my email address is redngoldtoad@hotmail.com

Thank you very much ! And Good Luck!

Sorry to hear about your situation but it really sounds like you are on the right track for finding a SOLUTION! Im still a newbie myself(a whole week so far) have seen some real support come from these forums. The responses I saw to your post further inspired me as well. But I really dont have a doubt you are gonna come out of this one sittin on top. Im still fighting creditors myself over old farming debts 250k down to 6k currently and UNSECURED whew in other words yep there is hope and after you win make sure he knows it!
