Who Should Pay?

I had two properties under contract that fell through prior to closing. I also had an assignment contract signed for one of them. The problem is, I ordered two title searches(200.00 a piece) for each property, to be paid for at closing, but we never closed. Who is responsible for paying these charges? I am about to get another property under contract and want to know if I need to cough up 400.00 before I can order another search.

    Usually the buyer pays because he wants to be assured the new title is clear of unknown/ undisclosed liens. It can also go either way, if agreed in the contract.
    I bought a home once when I refused the search because I was almost 98.9 % sure there was no problem or lien.

    Thanks for the reply.
    So because the deals did not go through, am I obligated to pay since technically I was the buyer on the contract?
