Rehab Woes

Anyone have any experience with painters doing a lousy job - wrong color - didn't prep or prime surface - painted things that shouldn't be painted and didn't paint other things - who wanted to be paid as though that were allright? Now the guy wants to put a lean on the property because my contractor refuses to pay him. He isn't interested in fixing the problem just wants to be paid.

    Hi Belle,

    I had a couple subscontractors pull that on me.....one a painter and the other a wood floor installer.

    In both cases I wrote a certified letter
    in which they had to sign for....detailing why I was not going to pay them. I further gave them a certain amount of time to make the corrections other wise
    I would bill them for the additional cost that I was going to incur as a result of their mess.

    Other than yelling alot....they let it go.
    Make sure you and your contractor document and take pictures of everything.

    In most states, a lien is only placed after a judgement is issued. ........most people
    dont want to go to court over something like that. You may want to talk to the clerk of small claims court to find out what options are available to you in your state.

    I doubt the painter has more than $300.00 in material............ I would see him in court just for principal.

    Of course make sure thing are spelled out next time......
