Handyman- not an employee?

I have found a great handyman who is venturing out on his own. I am contracting him to do maintainence, repairs, and to be 'on call' for emergencies. Part of his payment will be in the form a rent credit (this is in conjunction with a lease/option). What is the best way to handle this so that he does not become my employee?

    The IRS has a nice guide on the definition of employee vs. independent contractor. Do a search on***Must have at least 5 friends to unlock***v to find the document. It will provide some good guidance. I believe it is Publication 1779.[ Edited by SteveCoff on Date 06/25/2003 ]
