When Seller Married After They Bought A Home

woman is looking to sell her home due to the fact that she is remarried and no longer wants her old home.

does her husband have to sign all forms and cantracts when she sells now also?

    If this were in PA, the title company would most likely require the husband to sign off unless the wife produced a prenuptial agreement stating that the husband had no entitlement to the property.

    or the husband can quit his rights to the property via Quit Claim Deed.

    We are very advanced here in Calif.
    If the lady is properly divorced or took the property as sole and seperate it is hers and requires only the single signature. However If I am the Arb officer at your local Title Co. I am probably chicken and looking to hold my job, so I will ask for a quit claim deed from any husband prior or presentd and ask him to fill in a Statement of Identification which I will hold in the Title File, just in case. You just never know.

    So there, you got both, the legal and what really happens.
