This is for david lukas have you completed a subto deal yet in arkansas, I read your previous post and would like to know if you have completed one yet, since sub to deals are not heard of here at all. I am from arkansas, I am located deep, deep south. I would like to get your insight on this. since you are from here.

    I do not know GA law, but in FL "getting a divorace" means that he is still married and in FL the homestead property can only be sold if both the husband and wife sign the deed, even if only one of them is on title.

    You can go ahead and get everything signed tomorrow, just do not record the deed until you have a title commitment. If the title commitment says that you need the wife to sign, then you get new paperwork, otherwise what you have is fine.

    I just type my agreements. I know that they would not probably not pass any legal test, but my clients understand my intent.

    This agreement concerns the property located at _______________ ("Property"wink and is between Brenda (party1) and Henry (party2). Both Party1 and Party2 agree to the following:

    1) Party1 promises to keep the mortgage and property taxes of the Property current and in good standing.

    2) Party1 promises to payoff the existing mortgage on the Property prior to _____________________.

    3) Party2 promises to assist Party1 with any communication necessary with the lender, insurance company

    4) Party1 promses to pay Party2 ______ when the title of the Property is transferred to an entity which Party1 does not control.
