Should I Attempt A Short Sale When The Sellrs Are Suing The Mortgage Company?

I have come across a pre forclosure where the owners are suing their mtg. company on grounds of harrasment and the way that they were served the defult notice. Anyway, I would like advice on weather or not I should attempt to negotiate a short sale with the lender anyway ( or if it is even an option) I am thinking that the lender my be even more likely to accept the offer in order to end the lawsuit???

    An offer to purchase the real estate will most likely not stop the lawsuit, as this is not the complaint filed by the homeowners!

    The likelihood of the lender being willing to short sale is not good considering the litigation issue!

    I think the big question is the homeowners willing to sell the house to you?
