Short Sell Purchase

Hello all, I am a first time TCI member and have a question I need help with. I placed a bid for a home through my realtor that stipulated in the contract that it is a "short sell" with a third party approval. My initial bid was accepted by the homeowners and was being reviewed by the third party. The current owners purchased the house last year for $131,500.00 and I offered them $131,000.00 which they accepted. Since my initial offer my home inspector found a foundation problem with the garage that does not meet our "building code" and estimated $4800.00 in repair work. My attorney is preparing me for the third party to deny this money for repairs. Can they do that?
