Sec.8 Tenant Breaking Lease, What Are My Options

Hello, need help, my sec. 8 tenant is breaking lease. Several months left, but HUD is kicking them out of the program due to higher income (story I got). So do I get Ieft out on the cold? I just found this out, coming here for help first. Very busy at work, not much time to work on this BIG problem, I need to keep this house rented..

    have you had a good experience with HUD prior to this Scott? I hear bad things about renting through them.

    I have had good luck with Sec. 8 tenants. I would reccommend that you call the Sec. 8 worker and verify their story. If it is true wy not rent to them and they hav eot pay the full rent?
    If they are making too much money for sec. 8 then they should be able to pay your rent themselves.

    Oh my, I am in the same position with my section 8 tenants but it is abit complex here in NY. Section 8 has not paid the rent amount because they said the was some paperwork that the tenant failed to fill out and they suspended her benefits until march. The question now is what to do with the tenants, it is a single mom who is unemployed and sick but section 8 has not responded to me at all. I do not want to kick them out but i have not recieved full rent in 3 months. Any advice

    Just because HUD is taking your tenant off Section 8 assistance, does not mean you are losing a tenant. This just means the tenant will be responsible for 100% of the rent with no further assistance from HUD.

    Your lease is with the tenant, not with HUD. If the tenant is prematurely terminating their lease, then you have all the remedies provided by your local landlord tenant law available to you just as if your tenant had never been on the Section 8 program.

    If the tenant is breaking the lease because your rent is not affordable without the Section 8 assistance, then make it easy for the tenant to leave and get a new tenant in place as soon as you can.
