Lis Pendens Help Needed
Requested Final Payoff amount from sole owner held mortgage. Sole owner reports full amount is due claims never recieved a payment from go. Existing owner has cancelled check showing payments made and cashed. However previous seller has passed the loan over to someone else and this new someone has posted a lis pendens. Copies of the checks have been provied. My questions is should an answer to the LIs Pendens be filed?
Absolutely!!! If payments have been made and can be proved. The case could be thrown out. I have personally seen this happen. Good luck
