Hi,

I am starting an eviction process in California and I am not sure if 3 Day Notice inlcudes business days or calendar days.

Thanks,
Alla

In Fl it is business days, I would suspect the same for you

Here's how it works in California:

In counting the three days, you do not count the day on which the notice is served. You start counting with the day following the day the notice is served.

Also, while weekends and holidays do count, the last day of the three day period cannot be a weekend or holiday. For example, if the three day notice is served on Wednesday, the three days will be Thursday, Friday, and Monday, and the lawsuit can be filed on the following Tuesday. If, on the other hand, the three day notice is served in Saturday, the three days will be Sunday, Monday and Tuesday, and the eviction lawsuit can be filed on the following Wednesday.

    Hope this helps.

Thank you very much. I knew that the rules are not the same for different states.

You are very welcome. If you need a recommendation of a good eviction attorney in South Bay, PM me and I'll give you his information.
