Abandoned Mobile Home

I HAVE AN ABANDONED DOUBLE WIDE MOBILE HOME ON MY PROPERTY WHICH I HAVE BEEN TRYING TO GET THE FINANCE COMPANY TO MOVE FOR MONTHS NOW. I SENT THEM A DEMAND LETTER WHICH THEY SIGNED FOR ON DECEMBER 1ST. I HAVE HEARD EVERY EXCUSE FROM TAXES, TO PERMIT PROBLEMS, TO DEATH IN THE MOVERS FAMILY. LAST WEEKEND THEY ACTUALLY SENT SOMEONE TO SEE THE HOME ON MY PROPERTY. THEY ARE USING MY PROPERTY TO SELL THEIR HOME! WHAT CAN I DO? CAN I CHARGE THEM STORAGE FROM THE TIME OF THE DEMAND LETTER? I LIVE IN TEXAS. THANKS IN ADVANCE FOR YOUR REPLIES.

    I HAVE ANOTHER READY TO GO IN ITS PLACE AND HAVE ALREADY HAD TO MAKE THE FIRST PAYMENT ON IT. I AM AT MY WITS END!

    Deb,

    I belive the saying is "possession is 9/10 of the law".

    You should file with the DMV in TX for an abandoned property title to the DW. Generally this involves sending a return receipt to the last known owners address, le them know you are filing for abandoned title. Wait 30 days go to the DMV. Also, get an attorney draft a letter to the owner/s (around $200.00?).

    This should get their attention.

    Two things, deb,

    First the above is a pretty good answer to your question, While your attorney is drafting the letter, I'd also suggest that you get their professional advice on the subject and not rely on a bunch of answers from strangers.

    Second, on message boards, all caps is viewed as yelling. It is also very hard to read. I'd suggest not writing this way, as most won't even read an all caps post anymore. Moderators, as per forum rules, are supposed to actually delete all cap posts.

    Other than that, keep posting and let us know how it turns out.

    I have had the same problem here in Florida, currently have a court date to take the mortgage company to small claims to pay for taxes on the home that they didn't remove when we asked them to. So I will let you know what happens - also when they sold it on our property the new owners hired movers which damaged our property and they entered our property without permission.

    In the state of texas you have to send the finance company a possesary lein notice, giving them 15 days to pay the lot rent or move the home, you must send them this form certified mail, return receipt. On that 15th day they owe you, and can not remove the home till the bill is paid......it can take months

    Hello,

    I am buying Homes all over Florida and Georgia and as a buyer I am paying the back lot rents. This is how the lender is handing it with me.

    I dont mind even though I know I shouldnt, I do it because it has put me in good with the lender of which I am buying from .
    Besides, I tack the cost on to my buyers so Im not really out anything.

    To bad the home isnt here in Florida or Georgia because I might would like to buy it smile

    Place a note on the Home in every window!! ATTENTION BUYERS Do Not Move this Home until you have contacted YOUR NAME, Your PHONE NUMBER

    I have found many signs like this and I have gladly paid the back lot rent
