Need To Collect On Lien-Foreclosure

jjetts4 profile photo

I had placed a mechanics lien on a property. The house a few months later went to foreclosure and was sold. I learned about this after the fact as I was never notified by the courts.

Does anyone know the appropriate steps to find how to collect on that property and how it can be sold and transferred with an existing lien?

Thank you for any input.

How long ago did you place the lien? I believe mechanics lien expire.

It did not expire before the sale.

If the date the work was commenced was prior to the date of the execution of the foreclosing trust deed, then the foreclosing trust deed was junior to your mechanics lien and was not required to give you notice. In which case the successful bidder bought the property subject to your lien. By the way I am assuming you are in California.
